28-Physical Environment- Safe space
There shall be sufficient indoor and outdoor play space to ensure appropriate activities, safety and comfort for the day care children. The indoor and outdoor play space shall be neither isolated nor remote from the primary care areas. The outdoor play area shall be protected from traffic, bodies of water, gullies, and other hazards by barriers, in a manner safe for children. When there is a swimming pool or any other body of water at the facility or near enough to the facility to attract or be accessible to children at any time of the year, there shall be a sturdy fence/barrier, four (4) feet high or higher, with locked entrances, which totally and effectively bars access to the water by the day care children. Shallow wading pools that are not fenced shall be emptied after each use and shall not collect water.

39-Responsibilities of Provider & Substitute- Maintaining records on children
For each child enrolled, the provider shall maintain on file a current and complete enrollment form. The provider shall have a complete and current general health record, including immunization records, on file when the child begins attending the family child care home. The provider shall have on file an incident log for each enrolled child to record accidents, illnesses, unusual behaviors that occur at the facility and observations of the child made by the provider. The provider and staff shall not release any records pertaining to a child or family except in emergencies, or upon request of the Office of Early Childhood, police, or DCF, unless the parent of the child gives the provider and staff written permission to release the information.
